Because the majority of HIV-infected people independently try to protect healthy people from their illness (they immediately warn them before having sex, injections, etc.). And the number of intentional infections is extremely small in modern times and even entails criminal prosecution. Also, it is worth considering the immorality of this policy and unpopularity in society. No legislature would approve of such action for already suffering HIV patients.
