I have a negative attitude. Who invented this and when? Certainly not under the primitive system. Well, it could have been before fertilization in a test tube, just a child was made in the old grandfather's way, and without the participation of his own wife.
Yes, because it is a perversion. Well, God did not give children - life is so beautiful (the fact that this cruel reality spoils it very much is another matter). In extreme cases, you can take a child from an orphanage. Why is the absence of children such a tragedy? Why are they ready for anything, are treated for infertility, spending a lot of money (and often unsuccessfully), are they even ready for surrogacy? I think these are very limited people, not interested in anything. I am more interested in life on other planets than children.
And there are also all sorts of complications (not medical). Well, the fact that the surrogate mother has maternal feelings, and she refuses to give up the child - this happens (but will soon pass?). But it happens differently: a woman agreed to become a surrogate mother because of money, and she does not need a child at all. And suddenly: "Sorry, we have already adopted a wonderful child." Or the parents-to-be had to urgently leave (maybe even to another country). Or some kind of misfortune happened: the house burned down or destroyed by a natural disaster, or something else, but it was not up to the children. Or, God forbid, they died. What to do with a new baby? Send to an orphanage? Well, yes, such cases do not happen often, but they are not excluded.

It seems that everything is simple. There are people who want to give germ cells and pay, there are women who are ready to bear and give birth. Who cares.

But in fact, everything is extremely difficult.

Let's start with a basic proof that it is not easy.

In France, Germany, Austria, Norway, Sweden, some US states (Arizona, Michigan, New Jersey), surrogacy is completely prohibited.

In some jurisdictions, only non-commercial surrogacy is allowed - such are the Australian state of Victoria, UK (only payment of the surrogate mother's operating expenses is allowed), Denmark (with serious restrictions), Canada, Israel, Netherlands (advertising is prohibited surrogacy, offering of surrogate mothers services and their selection), some US states (New Hampshire, Virginia).

In Belgium, Greece, Spain, Finland, surrogacy is not regulated by law, but actually takes place.

The first aspect is trade in a body or a person. We see that this argument works for some countries.

Second aspect.

The question is - who is the parent, the one who owned the cells, or the one who gives birth, brings up? The answer is not as obvious as it seems at first glance. Otherwise, there would be no such thing as deprivation of parental rights. A rapist could claim parental rights to a child if he was born. Hence, the belonging of the cells is not an unconditional argument. And the law recognizes this. By law, a mother who gives birth has the right to be registered as a mother, even if she has accepted someone else's cells by agreement.

From a child's point of view, what's the difference whose cells were there? Mom is the one who loves, carries, feeds, cares.

Agreements do not resolve conflicts that in fact arise, therefore, in different countries developed in the legal sense, there are different practices.

This is a scary topic, but according to experts, it is relevant on this topic. Abortion. Does a woman have the right to have an abortion? By law it has. How do you argue when discussing abortion? "My body is my business." What about another option? Found some kind of disease in the embryo. The woman wants to give birth. Do customers have the right to insist on abortion? What if she doesn't agree? Forced? But the risks of diseases during such procedures are obviously high.

Agreement? Okay. And if you break the contract and return the money? Can I keep my child (according to the law - yes.)? And in conscience? Does the child have the right to both the mother who gave birth and the cells that gave birth (according to the law - indefinitely.)?
